What should I ask my broker about AI and my professional indemnity cover?
Ask your broker 10 specific questions before your next renewal. Whether any policy covers AI-assisted work depends on the policy wording and the insurer. Your broker is the right source for that answer. This article gives no opinion on coverage and lists questions to ask in writing.
Why ask now?
Commentary from brokers and law firms says insurers are asking more about AI use. A February 2026 piece from law firm Browne Jacobson lists questions professional indemnity insurers should ask clients about their AI use, including where AI is used, what it does and how outputs are monitored. Several broker articles from 2025 and 2026 report that some insurers are adding AI exclusions or endorsements.
These sources are commentary. No primary source from an Australian insurer or regulator was found for this article. Treat the questions below as a way to start the conversation. Your policy wording and your insurer decide the answers.
What are the 10 questions?
Put each question to your broker by email so you hold the answers in writing.
- Does my current policy contain any AI, generative AI or automated decision-making exclusion or endorsement?
- How does the policy define "artificial intelligence" or "generative AI"?
- Does work I produce with AI assistance still fall within the "professional services" the policy covers?
- What must I disclose about my AI use at proposal and at renewal?
- I started using AI tools after my last proposal. Do I need to tell the insurer now?
- If I use a third-party AI tool and it contributes to an error, whose cover responds first, and what do the tool vendor's terms say about liability?
- Does any AI endorsement carry a sublimit below my main limit of indemnity?
- Does my cyber policy respond if client data entered into an AI tool is exposed?
- Does my public liability policy have anything to say about AI?
- What evidence of human review, staff training or an AI policy does the insurer expect to see?
Question 6 draws on the broker articles' point that vendor terms and cover interact. Question 10 draws on Browne Jacobson's list of insurer questions about monitoring and oversight.
What should you bring to the call?
Brokers can answer more precisely when you describe your actual use. Prepare a one-page summary.
- The AI tools you use, by name.
- The client-facing work they touch.
- The review steps a person completes before work leaves your business.
- Whether staff have training or an AI policy. See the free government AI policy template.
- Whether your use has changed since your last renewal.
- What your AI vendors say about indemnity or liability in their terms.
What should you ask for?
Ask your broker to confirm each answer in writing. Ask for a copy of any AI endorsement and the policy wording it amends. Keep your summary and the broker's reply together with the policy documents. Set a diary note to repeat the questions at each renewal and whenever your AI use changes.
Your broker may answer that coverage depends on facts and wording. That answer is the broker doing the job. Ask what further information would let them give a firmer view.

Frequently asked questions
Does my professional indemnity policy cover AI mistakes?
This article cannot say. Coverage depends on the policy wording and the insurer. Ask your broker to confirm in writing whether work produced with AI assistance falls within your covered professional services and whether any AI exclusion applies.
Should I tell my insurer that I use AI?
Ask your broker what your policy and proposal form require. Broker commentary recommends raising changes in AI use at or before renewal. Your broker can tell you what applies to your policy.
